Introduction and Acceptance of Terms

Welcome to ChampagneApp, operated by MB "Champagne App" ("we," "us," or "our"), a company registered in Lithuania. These Terms & Conditions ("Terms") govern your access to and use of our mobile application (the "App") and related services.

By authenticating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

User Accounts and Eligibility

To access the core features of ChampagneApp, you must create a profile.

Age Gating: ChampagneApp provides educational content regarding wine. By creating an account, you strictly warrant that you are of legal drinking age in your current jurisdiction. We do not target or permit minors to use the App.

Authentication: We utilise Single Sign-On (SSO) via Apple ID and Google ID. We do not store passwords. You are responsible for maintaining the security of your Apple or Google account.

Account Suspension:We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, misrepresent your age, or engage in conduct that harms the community or the App's infrastructure.

Subscriptions, Free Trials, and Billing

ChampagneApp offers premium features accessible via auto-renewable subscriptions (Monthly and Yearly tiers).

Free Trial: We may offer a 14-day free trial for new subscribers. If you do not cancel at least 24 hours before the 14-day trial ends, your Apple or Google account will automatically be charged for the subscription tier you selected.

Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Payment Processing: All payments are processed entirely by the Apple App Store or Google Play Store. We do not collect or store your financial information.

Cancellations & Refunds: You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. Deleting your ChampagneApp account does not automatically cancel your app store subscription; you must cancel it directly with Apple or Google. Refunds are handled strictly according to the policies of the respective app stores.

User-Generated Content (UGC) & Community Guidelines

ChampagneApp allows you to submit, post, and share content, including tasting notes, cellar inventory details, photos, and private club communications (collectively, "User Content"). You retain full ownership of your User Content. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute this content to operate and improve the App.

Zero Tolerance for Objectionable Content and Abusive Behaviour: To maintain a safe and respectful community, we have a strict, zero-tolerance policy against objectionable content and abusive behaviour. You agree that you will not post User Content that:

• Is defamatory, discriminatory, harassing, abusive, or threatening.
• Contains hate speech, sexually explicit material, or promotes violence.
• Promotes the irresponsible, excessive, or illegal consumption of alcohol.
• Infringes upon the intellectual property or privacy rights of others.
• Contains spam, unauthorised advertising, or malicious code.

Moderation, Reporting, and Blocking: In compliance with app store guidelines, we provide built-in safety features:

• Reporting:You can flag inappropriate User Content or report abusive users directly within the App using the "Report" feature. We commit to reviewing and addressing all reports within 24 hours.
• Blocking: You have the ability to block other users within the App, which will immediately hide their User Content from your view and prevent them from interacting with you.
• Enforcement: We reserve the right to proactively filter, remove, or delete any User Content at our sole discretion. Any user found violating these guidelines will be subject to immediate content removal and permanent account termination.

Intellectual Property

Except for your User Content, the App and all of its original content, features, and functionality—including but not limited to text, educational materials, graphics, logos, and software—are owned entirely by MB "Champagne App" and are protected by international copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the App strictly for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of our Services without our express written consent.

Disclaimers and Limitation of Liability

Educational and Informational Purposes Only: ChampagneApp is designed to provide educational information, personal tracking, and community features related to champagne. The content provided within the App does not constitute professional, health, or investment advice. You are solely responsible for your own purchasing decisions and consumption habits.

"As Is" Service:The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the App. We do not guarantee that the App will be uninterrupted, error-free, or entirely secure.

Limitation of Liability:To the maximum extent permitted by applicable law, in no event shall MB "Champagne App", its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your access to or inability to access the App, or the conduct of any third party on the App.

Changes to Terms & Governing Law

Modifications: We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you within the App or via the email associated with your SSO account before the changes take effect. Your continued use of the App after the effective date constitutes your acceptance of the revised Terms.

Governing Law: These Terms shall be governed and construed in accordance with the laws of the Republic of Lithuania (EU), without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Lithuania.
